• “Replica” means any airsoft replica, gearbox, or component sent to us for customization, repair, or other work.
• “Order” means a confirmed request for our Services, including specifications, payment terms, and shipping arrangements.

• “Account” means the profile or record we maintain for you to track your orders, services, and communication.

3. Eligibility & Account Responsibilities

3.2 Accuracy of Information

You agree to provide accurate, current, and complete information when placing an Order. Any false or misleading information may result in suspension or termination of Services.

4. Description of Services

We provide worldwide shipping for the customization, repair, and modification of airsoft replicas. Our Services may include:

• External and internal customization
• Gearbox modifications
• Air-seal optimization
• Electronic unit installation and programming
• Diagnostic and cleaning services

Limitations:

• We only work on airsoft replicas intended for lawful recreational use.
• We do not sell or ship real firearms or any prohibited items.
• Modifications are performed according to your specifications, but performance results may vary based on the replica’s condition and compatibility.

5. Payment & Billing Terms

5.1 Pricing

All prices are listed in euros (EUR) unless otherwise specified. Prices do not include shipping costs, customs fees, import taxes, or duties, which are the customer’s responsibility.

5.2 Payment Methods

5.3 Late Payments

7. Intellectual Property Rights

10. Disclaimers & Limitation of Liability

10.1 Disclaimer of Warranties

• Specific performance outcomes or improvements.
• Complete compatibility with all third-party components or client-supplied parts.
• The absence of future malfunctions, wear, or failure of the replica.

All Services are provided “as-is” to the fullest extent permitted by law.

10.2 Limitation of Liability

To the maximum extent permitted by law, PeakAirsoft shall not be liable for any direct, indirect, incidental, consequential, or special damages, including but not limited to injury, loss, or property damage arising from:

1. Shipping and Transportation: Damage, loss, or delay of replicas or components while in transit to or from our workshop, including customs or courier issues. Clients are responsible for insuring shipments if desired.
2. Modifications and Performance: Any issues, malfunctions, or failures of the replica resulting from our modifications, including replicas breaking, jamming, or otherwise failing after use, regardless of the number of uses.
3. Client-Supplied Components: Any injury, damage, or loss caused by components provided by the Client, including batteries, electronics, attachments, or other parts. The Client acknowledges and assumes all risks associated with these components, including overheating, explosion, fire, or malfunction.
4. User Handling and Misuse: Damage, injury, or failure resulting from improper use, neglect, abuse, or failure to follow safety instructions.
5. Pre-Existing Conditions: Failures or malfunctions caused by defects or wear already present in the replica prior to modification.
6. Electronic and Software Risks: Malfunctions, data errors, or damage caused by installed electronic components, programming units, or other software-controlled systems.
7. Inherent Risks of Airsoft Replicas: Risks inherent to airsoft replicas, including mechanical, electronic, or material limitations that may cause unexpected behavior or failure.
8. Third-Party Actions: Any damages caused by courier services, customs officials, or other service providers involved in shipping or handling replicas.
9. Intellectual Property: PeakAirsoft is not liable for claims arising from client-provided designs, instructions, or parts that infringe third-party intellectual property rights.

The Client acknowledges and agrees that:

• Modified replicas carry inherent risks.
• They are solely responsible for the safe use of replicas after modification.
• They assume all risk related to batteries, electronics, and other high-risk components.

Maximum Liability: PeakAirsoft’s total liability for any claim arising from these Services, whether in contract, tort, or otherwise, shall not exceed the total amount paid by the Client for the specific Service giving rise to the claim.

10.3 Client Acknowledgment of Risks and Instructions

By using our Services, the Client expressly acknowledges:

1. They have read and understood all safety warnings provided by PeakAirsoft.
2. They are responsible for ensuring that replicas and components comply with all applicable laws and regulations.
3. They have provided complete and accurate specifications for the requested work.
4. They accept that replicas may fail, malfunction, or behave unpredictably due to modifications, pre-existing defects, or user handling.
5. PeakAirsoft is not responsible for any indirect or consequential damages, including property damage, lost income, or injuries caused by the modified replica.

11. Termination of Service

We may suspend or terminate Services if:

• You breach these Terms
• We suspect fraudulent or unlawful activity
• It becomes impossible to perform the Service due to legal or logistical reasons

You may terminate your Service request before work begins for a full refund. Once work has started, termination will not result in a refund unless otherwise agreed.

12. Governing Law & Jurisdiction

These Terms are governed by the laws of France. Any disputes will be resolved in the courts of PAris, France.

13. Changes to the Terms

We reserve the right to update or modify these Terms at any time. Changes will take effect immediately upon posting on our website, and continued use of our Services after changes constitutes acceptance of the updated Terms.
