1. Introduction & Acceptance of Terms

By accessing, using, or purchasing services from PeakAirsoft (“we”, “us”, “our”), you (“User”, “Customer”, “Client”) agree to be bound by these Terms and Services (“Terms”). These Terms form a legally binding agreement between you and PeakAirsoft. If you do not agree to these Terms, you must not use our services.

This agreement applies to all services we provide, whether purchased online, in writing, or through direct communication.

2. Definitions

• “Service”: airsoft replica customization, modification, diagnostic, cleaning, repair, and related services.
• “User” / “Customer” / “Client”: any individual or entity who requests, purchases, or uses our Services.
• “Replica”: any airsoft replica, gearbox, or component sent to us for customization, repair, or other work.
• “Order”: confirmed request for our Services, including specifications, payment terms, and shipping arrangements.
• “Intellectual Property”: all copyrights, trademarks, designs, and proprietary information owned by PeakAirsoft.
• “Account”: profile maintained for tracking orders, services, and communication.

3. Eligibility & Account Responsibilities

3.1 Age Requirement

You must be at least 18 years old or the legal age of majority in your country to request our Services.

3.2 Accuracy of Information

You agree to provide accurate, current, and complete information when placing an Order. Any false or misleading information may result in suspension or termination of Services.

3.3 Account Security and Management

• You are responsible for maintaining the confidentiality of your login information and all activities under your account.
• Accounts are created upon request and may be deleted by the user or PeakAirsoft upon written request.
• Personal data is handled according to our Privacy Policy and GDPR regulations.

4. Description of Services

• External and internal customization
• Gearbox modifications
• Air-seal optimization
• Electronic unit installation and programming
• Diagnostic and cleaning services

Limitations:

• Only lawful recreational airsoft replicas are serviced.
• No real firearms or prohibited items are sold or shipped.
• Modifications are performed according to your specifications; results may vary.
• International clients are responsible for compliance with local import/export laws.

5. Payment & Billing Terms

5.1 Pricing

All prices are in euros (EUR) unless specified. Shipping, customs, import taxes, or duties are the customer’s responsibility.

5.2 Payment Methods

We accept PayPal, bank transfer, or credit card. Full payment is required before work begins unless explicitly agreed in writing (“writing” includes email, signed quote, or official message).

5.3 Late Payments

Invoices unpaid after 30 days may result in suspension of Services and late fees.

5.4 Refunds & Rework

• Refunds are only available for defects directly attributable to PeakAirsoft.
• Requests must be made within 14 days of delivery.
• Refund or rework occurs only after inspection by PeakAirsoft.
• Droit de rétractation: as these services are custom-made, the client expressly waives the 14-day retraction period once work begins.

6. User Obligations

You agree to:

• Ensure your replica is legal to own and ship from your country to France and back.
• Remove non-related accessories before shipping.
• Provide clear written instructions.
• Not request services for unlawful purposes.

7. Intellectual Property Rights

• Designs, methods, and materials remain PeakAirsoft property unless otherwise agreed.
• Our business name, logo, website, and promotional materials are protected by copyright and trademark laws.

8. User-Generated Content

By providing images, videos, or descriptions, you grant PeakAirsoft a worldwide, non-exclusive, royalty-free license for promotion. Ownership remains yours.

9. Privacy Policy Reference

Personal information is processed per our Privacy Policy. We do not sell or share data without consent, except when required by law.

10. Disclaimers & Limitation of Liability

10.1 Disclaimer of Warranties

Services are provided “as-is”. Due to customization and replica variability, PeakAirsoft does not guarantee performance, compatibility, or absence of malfunction.

• Exceptions: legal warranties of conformity and hidden defects are respected.

10.2 Limitation of Liability

PeakAirsoft is not liable for:

• Shipping damage, loss, or delay. Clients may insure shipments.
• Malfunctions, failures, or breakages after modifications.
• Client-supplied components (batteries, electronics, attachments).
• Improper use, neglect, or abuse.
• Pre-existing defects.
• Electronic or software malfunctions.
• Inherent airsoft replica risks.
• Third-party actions (couriers, customs).
• Intellectual property claims from client-provided designs.

Maximum liability: total liability does not exceed the amount paid for the specific service.

10.3 Client Acknowledgment of Risks

By using our Services, clients acknowledge:

• Safety warnings are read and understood.
• Replicas comply with laws.
• Specifications are complete and accurate.
• Replicas may fail due to modifications, defects, or handling.

11. Termination of Service

Services may be suspended or terminated if:

• You breach the Terms.
• Fraudulent or unlawful activity is suspected.
• Legal or logistical reasons prevent service.

Full refund only before work begins, unless otherwise agreed.

12. Governing Law & Jurisdiction

French law applies. Disputes resolved in Paris courts. Parties agree to attempt mediation before litigation.

13. Changes to Terms

Updates take effect immediately upon posting on the website. Continued use constitutes acceptance.
